Rooftop Tower Ordered Removed From Building

The Law Office of James J. Corbett recently represented a building owner in an action against a telecommunications carrier in which the Court ordered the telecommunications carrier to remove its rooftop tower and equipment from the building and permanently vacate the building.

After entering into a rooftop lease with the building owner, the carrier constructed a rooftop tower and facilities that were unsafe and  did not comply with the plans it submitted to the municipality.  At a hearing, the Court found the carrier’s facilities to be unsafe and illegal.

 

Municipality Temporarily Enjoined From Constructing and Operating 125 Foot Tower

The Law Office of James J. Corbett recently obtained a temporary restraining order enjoining the construction and operation of a 125 foot cell tower in a residential neighborhood.  The tower was constructed pursuant to a lease between the municipality as landowner and a tower construction company that was building the tower for a number of telecommunications carriers.  The 125 foot tower was constructed within 30 feet of the nearest residential home and within 150 feet of other homes.  The temporary restraining order prevents the municipality from allowing any further construction of the tower or operation of the tower until the matter is heard by the Court.

 

Condo Board and Cell Carrier Temporarily Enjoined From Construction of Cell Facilities on Roof of Building

The Law office of James J Corbett recently obtained a temporary restraining order enjoining the construction and operation of wireless telecommunications facilities on the roof of a condo building. The condo board and cell carrier entered into a lease whereby the cell carrier was to construct its facilities on the roof and other areas of the building. Neither the condo board nor the cell carrier informed the occupants of the condo that the lease had been entered into. It was not until the cell carrier started construction of its facilities that the condo occupants were made aware that the condo board had entered into a lease which would allow the cell carrier to construct and operate its facilities on the roof, which was a common area utilized as a sundeck by the condo occupants.The facilities would also be within feet of the outdoor terraces for the penthouse units of the condo.

Within days of being retained, and one day before the cranes were scheduled to arrive at the building to construct the facilities on the roof, the Law office of James J Corbett obtained a temporary restraining order halting the construction.
