The fact that the private or public property on which cell carriers construct and operate their facilities is in a residential neighborhood or in close proximity to schools or within feet of a private home, is of little concern to cell carriers. However, the effects of such facilities is of utmost concern to the residents of the neighborhood.

Municipal Claims

Throughout the country municipalities have been allowing cell carriers to construct facilities on property owned by the municipality. Many times the municipal property upon which the facilities are built are in residential neighborhoods or in close proximity to other buildings. Although the Telecommunications Act provides substantial leeway for the construction of telecommunications facilities on municipal property, residents have some recourse against municipalities and telecommunications carriers.

Municipality Temporarily Enjoined From Constructing and Operating 125 Foot Tower

The Law Office of James J. Corbett recently obtained a temporary restraining order enjoining the construction and operation of a 125 foot cell tower in a residential neighborhood.  The tower was constructed pursuant to a lease between the municipality as landowner and a tower construction company that was building the tower for a number of telecommunications carriers.  The 125 foot tower was constructed within 30 feet of the nearest residential home and within 150 feet of other homes.  The temporary restraining order prevents the municipality from allowing any further construction of the tower or operation of the tower until the matter is heard by the Court.
